Shell Recharge 應用程式或網頁版:一般使用條款及細則
使用此流動應用程式或網頁版(「應用程式」)之前請先仔細閱讀相關使用條款及細則。如果進入或使用在任何電腦、手機、平板電腦,操控臺或其他裝置上使用應用程式的任何應用程式或功能(統稱為「裝置」及每部「裝置」),即證明您已確認閱讀、瞭解且同意遵循此使用條款及細則和任何其他適用法律。
如果您不同意此使用條款及細則,請勿存取或使用本應用程式或其任何功能。
1. 持有人及營運商資訊
1.1. 本應用程式由希路能源有限公司(「希路」)擁有並提供營運及技術支援。希路並將應用程式授權發給香港蜆殼有限公司及蜆殼澳門石油有限公司(「蜆殼」)。
1.2 在此使用條款及細則中,任何對「蜆殼」或「我方」的提述都被視為對蜆殼公司集團的提述,或為蜆殼公司集團中任一一間公司之提述(倘無必要指出相關具體公司)。
2. 用戶限制及存取
2.1. 本應用程式僅適用於駕車人士,不適用於沒有法定駕車權利的人士。駕車時不得存取或使用本應用程式。
2.2. 如要使用本應用程式的功能,您需要建立 Shell Recharge 會員帳戶並成功登入。我們將視使用您帳號名稱與密碼者為「您本人」。我們將賦予該使用者與您相同的權利,並將您視為該帳號所有行為的負責人。建議您妥善保管帳號名稱與密碼,切勿與他人分享,以防他人冒充您使用本應用程式。如您懷疑帳號遭濫用,請立即通知我們。聯絡方式詳見第 13 條(投訴程序)。
2.3. 請注意,本應用程式的某些功能需要上網方可使用。
3. 可接受使用
3.1. 您可以:
- (a) 存取本應用程式的任何部份(要成為 Shell Recharge 會員計劃客戶方可存取應用程式的會員計劃功能);及
- (b) 列印任何或所有頁面副本,用於個人非商業用途。
3.2. 除上述允許情況外,您不得:
- (a) 複製(列印到紙張、儲存於磁碟、下載或以任何其他方式)、散佈(包括散佈副本)、廣播、以任何方式更改或篡改或以任何方式使用本應用程式所含之任何資料(包括用戶製作內容,但不包括您以合法方式發佈至應用程式或相關論壇)(除非上文第 3.1 條文另有規定)。此限制規定適用於全部或部份內容;
- (b) 從任何應用程式中複製或列印的材料裏面移除載於原始材料中的任何版權、商標或其他知識產權聲明;
- (c) 未經殼牌書面授權許可,不得連結至本應用程式,且此類請求應依本文件第 3.3 條之規定提出;
- (d) 出於任何違法用途,以任何違法方式或以違反此使用條款及細則之方式使用應用程式(或其任何部份),或做出欺詐或惡意行為(如非法入侵他人電腦或插入惡意代碼,包括在應用程式或任何作業系統插入病毒或有害資料);
- (e) 以可能會損壞、停用、過載、破壞或危及蜆殼及希路系統或安全性或影響其他用戶的方式使用應用程式;
- (f) 從應用程式或系統收集或獲取任何資訊或資料,或嘗試解密操作應用程式伺服器的任何傳輸;或
- (g) 從應用程式下載或列印的材料中更改或刪除任何所有權聲明;
- (h) 在沒有經過蜆殼及希路明確書面同意的情況下規避或修改任何應用程式安全科技或軟件。
3.3. 在符合 3.2(c) 的規定下,如果您想要提供本應用程式的超文字或其他連結,請傳送電郵至 support@halo-e.co,並附上以下詳細資料:
- (a) 您想要連結至本應用程式的網頁的 URL;及
- (b) 您想要連結的本應用程式的網頁的 URL。
3.4. 根據上文第 3.3 條文的規定,蜆殼及希路可對任何請求做出全權同意或拒絕的決定。蜆殼及希路沒有義務同意任何此等請求或提供接受或拒絕任何此等請求的理由。
4. Shell Recharge 會員計劃條款及細則
如果您註冊成為 Shell Recharge 會員並成功登入帳戶使用本應用程式,即表示您同時同意遵守會員計劃的條款與細則。
5. 流動服務
本應用程式可免費使用,但需注意您的營運商會收取標準費用。本應用程式含有可用於特定流動裝置的服務及功能特色。使用本應用程式即表示您同意我們可通過電子方式連線至您的流動裝置並與您聯絡,且您使用此服務時的相關資訊可與蜆殼及希路分享。如果您更改或撤銷手機號碼,您必須立即更新帳戶資料,以確保我們不會將您的訊息傳送至使用您的舊號碼的人士。
6. 安全性
6.1. 以有是項功能提供為前提下,如果您在執行蜆殼及希路安全性程序過程中選擇或獲得用戶名稱、密碼或任何其他資訊,您必須保密管理此類資訊,不可向任何第三方公開或允許任何未獲授權人士以您的用戶名稱及/或密碼存取應用程式。您需承擔使用您的應用程式帳戶或通過您的裝置使用應用程式執行任何操作帶來的責任,蜆殼及希路不承擔因非法使用您的用戶名稱及/或密碼而導致的任何損失(無論您是否知情)。
7. 知識產權(“IPR”)
7.1. 本應用程式所包含的所有知識產權歸蜆殼或其許可人所有。應用程式所含的所有內容(包括但不限於文字、軟件、指令碼、代碼、設計、圖表、相片、聲音、音樂、影片、互動功能特色及所有其他內容「內容」為適用版權法律的集體創作,屬於蜆殼或其許可人所有的知識產權。蜆殼或其許可人所有保留本應用程式所含的 IPR 及相關內容的所有權利。
7.2. 尤其,本應用程式含有的商標包括但不限於「蜆殼」標誌及蜆殼徽章。本應用程式所含的所有商標之持有人為蜆殼或其許可人。蜆殼或其許可人保留所有本應用程式所含商標的所有權利。任何人不得在未經蜆殼法律部門書面同意的情況下,複製、仿效或使用蜆殼或其母公司或關聯公司的名稱或標誌。
7.3. 為清晰起見,關於上述第 1.1 條文的解釋,蜆殼在本應用程序中的擁有權僅指第 7.1 和 7.2 條文規定,關於本應用程式中包含的知識產權、內容和商標。本應用程序是希路授予的許可,源自希路的在線電動汽車充電平台,而該平台是由希路全資擁有。為免疑義,此區分不影響蜆殼對其營運的充電站所產生、衍生或相關的任何資料、內容或技術的擁有權。
7.4 此條款及細則沒有授予您任何 IPR 的許可,這類 IPR 許可由蜆殼或其許可人所持有。
8. 資料保護及私隱政策
8.1. 根據我方的私隱政策,我方使用您通過本應用程式向任何蜆殼公司及希路能源有限公司提供的與您相關的個人資料。請仔細閱讀相關條文後再繼續。根據我們的私隱政策,下載本應用程式即表示您同意使用這一資訊,此私隱政策已通過附注納入此使用條款及細則。
9. 免責聲明及責任
9.1. 您需對您所輸入或提交至應用程式的資訊的準確性負責。雖然蜆殼及希路已盡力確保應用程式提供的任何資訊在加入應用程式時的正確性,但蜆殼及希路概不保證此等資訊的準確性。
9.2. 在法律許可的最大範圍內,蜆殼及希路不承擔本應用程式相關操作及使用的所有明確的或暗含的保證。您明白並同意使用本應用程式時須自行承擔風險,並應自行對以下損害負責:裝置使用、用於存取應用程式的裝置的損壞、資料丟失或由於下載、存取或使用本應用程式而導致的任何類型的其他損害。
9.3. 在法律許可的最大範圍內,蜆殼及希路在任何情況下均不對您因使用本應用程式或對您因依賴本應用程式所載的任何資訊或建議或相關行為而發生之合同侵犯(包括疏忽)、違反法定責任或其他責任承擔以下責任:
- (a) 實際或預期利潤、銷售、儲蓄、使用、業務、商務損失或收益損失;
- (b) 業務中斷導致的損失;
- (c) 商譽或聲譽損失;
- (d) 資料、資訊或軟件的損失或損毀;或
- (e) 因使用應用程式或發佈於應用程式的任何資料而引起的任何間接、特殊或後續成本、費用、損失或損害,
(即使您及/或蜆殼和希路已合理預測或可能合理預期會出現此等成本、費用、損失或損害時亦然)。
10. 外部網站及應用程式
10.1. 應用程式可能包含外部網站或應用程式連結。您瀏覽至此等連結時,外部網站或應用程式可能會以全螢幕方式顯示(在這種情況下,您需要使用裝置按鈕以返回至應用程式),在一些情況下,外部網站或應用程式會顯示在應用程式框中(在這種情況下,您可以使用應用程式框中的導覽按鈕以返回至本應用程式)。提供這些連結的目的是幫助您快速方便地找到您可能感興趣的相關網站、應用程式、服務及/或產品。您需自行決定任何此等網站或應用程式提供的任何服務及/或產品是否符合您的要求。蜆殼及希路不對此應用程式或服務的持有人或營運商承擔責任,亦不對其提供之任何商品或服務、其網站或應用程式的內容承擔責任,且不做出或簽署與此相關的任何細則、保證或其他條款或陳述或接受任何相關責任(包括任何宣稱本應用程式所含的任何外部網站或應用程式之內容含有侵犯任何第三方知識產權連結而引起的任何責任)。
11. 更改/操作應用程式
11.1. 蜆殼及希路可隨時更改本應用程式中的所有部份或任何部份的格式及內容,包括但不限於移除應用程式中的功能特色及功能。
11.2. 為更新內容或滿足任何其他需要,蜆殼及希路可暫停執行本應用程式或其特定特性或功能,或暫停支持或維護應用程式。
11.3. 我們經常通過 Appstore 或 Google Play 發佈應用程式更新。視更新而定,您可能需要下載應用程式的最新版本且接受新條款後才能使用完整的應用程式或其部份功能。
12. 權利轉讓
12.1. 蜆殼可將此使用條款及細則項下的權利及義務轉讓予任何蜆殼附屬公司及/或希路。任何此類轉讓均不影響您根據此使用條款及細則所享有的權利或蜆殼及希路應承擔的義務。
13. 投訴程序
13.1. 如果您有與應用程式相關的問題或投訴,請電郵至 support@halo-e.co
14. 可區分性
14.1. 此使用條款及細則的任何一條文或子條文均具有單獨法律效力。若任何法庭或相關部門決定任何條文不合法或無法執行,其他條文或子條文仍然有效。
15. 終止
15.1. 蜆殼及希路保留因任何理由或無理由自行決定終止您的帳戶及/或您存取這一應用程式或其任何功能、刪除您的資料及您的任何用戶製作內容及/或隨時限制您使用應用程式所有部份或任一部份的權利,無需通知,亦無需對您或他人承擔責任。蜆殼及希路亦保留禁止存取應用程式或其任何功能或功能特色的權利。
15.2. 您若根據第 17 條文採取行為後,您不可建立新帳戶以規避帳戶終止、刪除或限制。
15.3. 您明白並同意在您的帳戶及/或應用程式存取權限被終止後,您的某些用戶製作內容仍可能會繼續顯示在應用程式中或通過應用程式顯示,或在合理的時段內儲存為備份副本。
15.4. 您的帳戶及/或應用程式存取權限被終止後,此使用條款及細則仍然有效。
16. 此使用條款及細則的更改
蜆殼及希路可隨時更改此使用條款及細則而恕不另行通知,更改生效時間為修改後應用程式使用條款及細則的發佈時間。倘使用條款及細則有所修改,我們會在您下一次使用應用程式時要求您接受修訂後的使用條款及細則。此後使用應用程式須遵循修訂後的使用條款及細則的規定。
17. 司法管轄權
此使用條款及細則受香港法律規管並依其解釋,倘因此等條款及細則而出現任何糾紛或因應用程式而出現任何糾紛,香港法庭對此等糾紛具有非專屬司法管轄權。
Terms and Conditions
Shell Recharge Applications: General Terms and Conditions of Use
Please read these terms and conditions of use carefully before using this mobile application or website (the “App”). By accessing or using this App or any functionality thereof on any computer, mobile phone, tablet, console or other device (together “Devices” and each a “Device”), you confirm that you have read, understood and agreed to be bound by these Terms and Conditions of Use and any other applicable law.
If you do not agree to these Terms and Conditions of Use, please do not access or use the App or any functionality thereof.
1. Owner and Operator Information
1.1. The App is owned, technically supported and operated by Halo Energy Limited (“Halo”). Halo has licensed the App to Shell Hong Kong Limited and Shell Macau Petroleum Company Limited (“Shell”).
1.2. For the purpose of these Terms and Conditions of Use, any reference to “Shell”, “we” or “us” may be a reference to the Shell group of companies in general, or to any one company within the Shell group of companies if no useful purpose is served by identifying that specific company.
2. User Restrictions and Access
2.1. This App is intended for motorists only and may not be used by any person who is not legally entitled to drive a motor vehicle. It should not under any circumstances be accessed or used whilst driving.
2.2. In order to use this App, you are required to register and sign in as a Shell Recharge member. We will treat anyone who uses Your username and password as "You". We will provide this user with all of the rights that We provide to You, and We will hold You responsible for the activities of anyone using Your username and password. We recommend that You keep Your username and password in strict confidence, and that You do not share this information with anyone who might "pretend" to be You with respect to the use of the Shell App. Please notify Us immediately if You suspect that someone is using Your username and/or password inappropriately. Our contact information is included in Section 13 (Complaints Procedure) below.
2.3. Be aware that the use of some of the functionalities of this App require access to the Internet.
3. Acceptable Use
3.1. You may:
- (a) access any part of the App (Shell Recharge customers will be able to access the key function(s) within the App); and
- (b) print off one copy of any or all of the pages for your own personal non-commercial use.
3.2. You may not, except as permitted above:
- (a) copy (whether by printing off onto paper, storing on disk, downloading or in any other way), distribute (including distributing copies), broadcast, alter or tamper with in any way or otherwise use any material contained in the App (including User Generated Content, unless it is your own User Generated Content that you legally post to the App or associated forum) except as set out under Clause 3.1 above. These restrictions apply in relation to all or part of the Content;
- (b) remove any copyright, trade mark or other intellectual property notices contained in the original material from any material copied or printed off from the App;
- (c) without the written authorized permission of Shell, which such request should be made in accordance with provision 3.3 herein, link to the App;
- (d) use the App (or any part of it) in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms and Conditions of Use, or act fraudulently or maliciously, for example, by hacking into or inserting malicious codes, including viruses, or harmful data, into the App or any operating system;
- (e) use the App in a way which could damage, disable, overburden, impair or compromise Shell and Halo’s systems or security or interfere with other users;
- (f) collect or harvest any information or data from the App or our systems or attempt to decipher any transmissions to or from the servers running any part of the App; or
- (g) change or delete any ownership notices from materials downloaded or printed from the App;
- (h) circumvent or modify any App security technology or software, without Shell and Halo’s express written consent.
3.3. Subject to Clause 3.2(c), if you wish to provide a hypertext or other link to this App, please email support@halo-e.co with details of:
- (a) the URL(s) of the web page(s) from which you are proposing to link to this App; and
- (b) the URL(s) of the web page(s) on this App to which you are proposing to link.
3.4. Shell and Halo may, at its sole discretion, agree to or reject any request made in accordance with Clause 3.3 above. Shell and Halo have no obligation to agree to any such request or to provide any reason for accepting to rejecting any such request.
4. Shell Recharge Loyalty Program Terms and Conditions
In accessing or using the App by logging in to your Shell Recharge account, then your use of the Shell Recharge service will also be subject to the Shell Recharge Terms and Conditions.
5. Mobile Services
The use of the App is for free but be aware that your carrier´s normal rates apply. The App contains services and features that are available to certain mobile Devices. By using the App, you agree that we may communicate with you by electronic means to your mobile Device and that certain information about your use of these services may be shared with Shell and Halo. If you change or deactivate your mobile phone number, you have to immediately update your account information to ensure that we don't send your messages to the person who acquired your old number.
6. Security
6.1. If you choose or are provided with a username, password or any other piece of information as part of Shell and Halo’s security procedures, you must treat such information as confidential and you must not disclose it to any third party nor allow any unauthorized person access to the App under your username and/or password. You are responsible for any actions that take place while using your App account or while using the App via your Device. Shell and Halo are not responsible for any loss that results from the unauthorized use of your username and/or password, with or without your knowledge.
7. Intellectual Property Rights (“IPR”)
7.1. All intellectual property contained in or on the App is owned by Shell or its licensors. All content in the App including, but not limited to, text, software, scripts, code, designs, graphics, photos, sounds, music, videos, interactive features and all other content (“Content”) is a collective work under applicable copyright laws and is the proprietary property of Shell or its licensors. Shell or its licensors, reserves all of its rights in respect of the IPR contained in the App and in respect of the Content.
7.2. In particular, this App contains trademarks including, but not limited to, the mark "Shell" and the Shell emblem. All trademarks included on this App are owned by Shell or its licensors. Shell and its licensors reserve all of their rights in respect of the trademarks included on this App. You shall have no right to, and You shall not, copy, imitate, or use the name or logo of Shell or any of its parents or affiliates without Shell legal officer's written consent.
7.3. For clarity, Shell’s ownership in the App refers only to the intellectual property, trademarks, and Content specifically related to the Shell brand, as outlined in Clauses 7.1 and 7.2 above. The App is based on a proprietary platform owned by Halo and licensed to Shell. For the avoidance of doubt, this distinction does not affect Shell’s ownership of any data, content, or technology created, derived from or related to Shell-operated charging stations.
7.4. Nothing in these Terms and Conditions of Use shall be interpreted as granting to you any license of IPR owned by Shell or its licensors.
8. Data Protection and Privacy Policy
8.1. Personal details and other information relating to you provided to any Shell company and Halo through this App will only be used in accordance with our Privacy Policy. Please read this carefully before continuing. By downloading the App you are consenting to use of this information in accordance with our Privacy Policy, which is incorporated into these Terms and Conditions of Use by this reference.
9. Disclaimer and Liability
9.1. You are responsible for the accuracy of the information that you enter or submit into the App. While Shell and Halo do its best to ensure that any information provided as part of this App is correct at the time of inclusion on the App, Shell and Halo cannot guarantee the accuracy of such information.
9.2. To the fullest extent permitted by law, Shell and Halo disclaim all warranties, express or implied, regarding the operation and use of the App. You understand and agree that you use the App at your own risk and that you are solely responsible for your use and for any damage to the Device through which you access the App, loss of data or any other harm of any kind which may result from downloading, accessing or using the App.
9.3. To the fullest extent permitted by law, Shell and Halo shall under no circumstances whatsoever be liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with either your use of this App, or for your reliance on any information or advice contained in the App for:
- (a) loss of actual or anticipated profit, sales, savings, use, business, business opportunity or revenue;
- (b) losses caused by business interruption;
- (c) loss of goodwill or reputation;
- (d) loss or corruption of data, information or software; or
- (e) any indirect, special or consequential cost, expense, loss or damage suffered by you in connection with your use of the App or any materials posted on it, even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by you and/or Shell and Halo.
10. External Websites and Applications
10.1. The App may include links to external websites or applications. When you follow such links the external website or application may appear as a full screen (in which case you will need to use the Device button to return to this App) or in some cases it may appear within the frame of this App (in which case you will be able to return to this App by using the navigation buttons within the frame or this App). These links are provided in order to help you find relevant websites, applications, services and/or products which may be of interest to you quickly and easily. It is your responsibility to decide whether any services and/or products available through any of these websites or applications are suitable for your purposes. Shell and Halo are not responsible for the owners or operators of these applications or websites or for any goods or services they supply or for the content of their websites or applications and does not give or enter into any conditions, warranties or other terms or representations in relation to any of these or accept any liability in relation to any of these (including any liability arising out of any claim that the content of any external website or application to which this App includes a link infringes the intellectual property rights of any third party).
11. Changes to/Operation of the App
11.1. Shell and Halo may change the format and content of all or any part of this App at any time, including but not limited to removal of features or functionalities in the App.
11.2. Shell and Halo may suspend the operation of this App, or of certain of its features or functionalities, for support or maintenance work, in order to update the content or for any other reason.
11.3. Updates to the App may be issued from time to time through the Appstore or Google Play. Depending on the update, you may not be able to use all or part of the App until you have downloaded the latest version of the App and accepted any new terms.
12. Transfer of Rights
12.1. Shell may transfer its rights and obligations under these Terms and Conditions of Use to any affiliate of Shell and/or Halo. Any such transfer will not affect your rights or Shell and Halo’s obligations under these Terms and Conditions of Use.
13. Complaints Procedure
13.1. If you have a question or complaint about this App, please email support@halo-e.co.
14. Severance
14.1. Each of the Clauses or sub-clauses of these Terms and Conditions of Use operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining Clauses or sub-clauses will remain in full force and effect.
15. Termination
15.1. Shell and Halo reserve the right in its sole discretion to terminate your account and/or access to this App or any functionalities thereof, delete your profile and/or restrict your use of all or any part of the App at any time, for any or no reason, without notice and without liability to you or anyone else. Shell and Halo also reserve the right to prevent access to the App or any of its functionalities or features.
15.2. After any line of action subject to Clause 15.1 you are not allowed to create a new account to circumvent the termination, deletion or restriction.
15.3. You understand and agree that some of your User Generated Content may continue to appear on or through the App or may persist in backup copies for a reasonable period of time even after your account and/or access to the App is terminated.
15.4. These Terms and Conditions of Use remain in effect after your account and/or access to the App is terminated.
16. Changes to these Terms and Conditions of Use
Shell and Halo may change these Terms and Conditions of Use at any time without notice, effective upon posting the amended Terms and Conditions of Use to the App. In the event that the Terms and Conditions of Use are amended, you will be asked to accept those revised Terms and Conditions of Use when you next use the App. Any use of the App thereafter will be on the basis of those revised Terms and Conditions of Use.
17. Jurisdiction
These Terms and Conditions of Use are governed by and to be interpreted in accordance with the laws of Hong Kong and in the event of any dispute arising in relation to these terms and conditions or any dispute arising in relation to the App the courts of Hong Kong will have non-exclusive jurisdiction over such dispute.

1. 本私隱政策的適用於甚麼範圍?
本私隱政策適用於我們處理您作為 (i) 我們的客戶,(ii) 會員計劃之客戶,(iii) 蜆殼香港及澳門網頁 (網頁) 的瀏覽者及/或 (iv) Shell Recharge用戶的個人資料。
在網頁上您會發現一些其他網站或應用程式的鏈接。儘管這些網站或應用程式經過小心選擇,我們對這些網站或應用程式處理您的個人資料概不負責。因此,本私隱政策並不適用於使用這些網站或應用程式。
2. 誰負責管理您的個人資料?

If you contact our Customer Service Centre with a question or a complaint, we may ask you for certain information to identify yourself and to help us respond to your enquiry. We use any personal data supplied only for this purpose and to improve our customer support services.
Which personal data do we process for this purpose?
To be able to respond appropriately to your question or complaint, we note details of your question or complaint in our customer database. We may also ask you for contact details in order to keep you informed about your question or complaint. What does this purpose entail?

As a customer of Shell or a member of our Loyalty Program, you may receive general offers and information from Shell and Halo (“General Offers”).
With General Offers, we would like to notify you of Shell products, events and promotions that may be of interest to you. You may receive your General Offers by regular mail, email, SMS, through the Loyalty Program Website, App (through push notifications), social media, coupons or any other digital channels used by you. If you are a Loyalty customer you may adjust your Contact Preferences & Account Settings at any time via the Loyalty Program Website.

For sending you General Offers, we may process the personal data provided by you (including your name, telephone number, e-mail address and car model).
Opting out of General Offers
You can at any time stop receiving General Offers by opting out via the App Settings. We will delete or render anonymous any personal data that is no longer needed to serve you with General Offers.
3.5. Personalised Offers
What does this purpose entail?
As a customer of Shell or a member of our Loyalty Program, you may receive offers from Shell and Halo that are tailored towards your personal preferences based on analyzing your purchase history, your participation in promotions, surveys, the Loyalty Program and your use of Websites, Apps and other digital channels (“Personalised Offers”).
With Personalised Offers, we would like to notify you of Shell products, events and promotions that we believe may be of interest to you. You may receive your Personalised Offers by regular mail, email, SMS, through the Loyalty Program Website, App (through push notifications), social media, coupons or any other digital channels used by you. If you are a Loyalty customer you may adjust your Contact Preferences & Account Settings at any time via the Loyalty Program Website.
Which personal data do we process for this purpose?
In order to be able to provide you with Personalised Offers, Shell and Halo need to understand your preferences. In order to be able to determine your preferences, Shell and Halo may analyse:
- Your purchase history;
- This includes data regarding (i) specific services you purchase, (ii) the total amount of your purchases per transaction, (iii) the time and place of the purchases you make and (iv) the payment method you use.
- How you use your coupons;
- This includes data regarding (i) the quantities of coupons you have used, (ii) the type and description of the coupon you have used, and (iii) the frequency and time of redemption of your coupons.
- If, how and where you redeem offers (including coupons);
- Your use of the Website, App and e-mails you receive from us

In order to determine your preferences, Shell may also combine your personal data already known by affiliates of Shell and Halo including your use of:
- the Loyalty Program;

- Transaction details at Shell Recharge facilities, along with purchases of customers with similar interests and supplemental socio-demographic information about you from third party sources in order to analyse your previous purchases.
Opting out of Personalised Offers
You can at any time stop receiving Personalised Offers by opting out via the App Settings. We will in such case stop analysing your personal data and purchasing habits, and delete or render anonymous any personal data that is no longer needed to serve you with Personalised Offers.
3.6. Administering our Loyalty Program
What does this purpose entail?
We process your personal data in order to administer your participation in our Loyalty Program.
Which personal data do we process for this purpose?
We may process any or all of the personal data provided by you during your enrollment in the Loyalty Program, such as your name, telephone number, e-mail address and car model.
Opting out of the Loyalty Program
You can choose to discontinue your participation in the Loyalty Program entirely at any time by contacting Shell and Halo at support@halo-e.co. We will then delete or render anonymous any personal data you provided to us when you enrolled for the Loyalty Program.
3.7. Technical and functional management of the Website and App
What does this purpose entail?
When you visit or use the Website or App, we process some technical information about you (such as your IP address, your location as obtained through our App if this is something that you have previously consented to) and provide you the functionalities of our online services and to manage them. With this technical information we are able to manage the Website and Apps, for example to resolve technical failures or to improve their reliability.
Which personal data do we process for this purpose?
We process technical data such as the IP address, your location and recorded journeys and vehicles co-ordinates, speed and acceleration on Shell Drive of your computer, tablet or smartphone, details of the pages you have visited on the Website or App, the web browser you use to surf, previous/subsequent sites that you have visited and the length of your visit/session.
3.8. The generation of management information and statistical data
What does this purpose entail?
Shell and Halo perform research into market trends through statistical analysis. We use the results of such research to evaluate our current products and services and to adapt our products, marketing and service stations to new developments. The research results are only reported on an aggregate basis.
3.9. Preventing, detecting and investigating fraud
What does this purpose entail?
Shell and Halo may use the personal data you provide Shell to prevent, detect and investigate fraud and to enforce its Terms and Conditions.
3.10. Feedback and forum facilities
If at any time Shell Recharge offers any feedback and/or forum facilities (or similar), Shell and Halo may collect the information that you disclose in using such facilities. Such information will be used in accordance with this Privacy Policy. 4. Who has access to your data?
Shell and Halo may disclose your personal data to any of the following:
- Authorized third party companies involved in the operation of the Loyalty Program, such as any other company that is permitted to supply products and/or services to Loyalty Program members;
- Any agents, service providers and/or subcontractors of Shell and its affiliates;
- Any person to whom Shell and Halo propose to transfer any of its rights and/or duties.
Shell and Halo use third parties for certain processings, such as website hosting. The collected personal data may be transferred to authorized third parties, which may be located outside of the Economic European Area (EEA) as part of the services offered to you. By way of example, this may happen if any of our servers are from time to time located in a country outside of the EEA or one of our service providers is located in a country outside of the EEA. As far as these third parties have access to personal data in order to execute these processings, Shell and Halo have taken the required organizational and/or contractual measures to ensure that your personal data is exclusively processed for the purposes mentioned above and that adequate levels of protection have been implemented in order to safeguard your personal data.
Except as set out in this Privacy Policy, we will not disclose any personal data without your permission unless we are legally entitled or required to do so or if we believe that such action is necessary to protect and/or defend our rights, property or personal safety and those of our users/customers or other individuals. Only if Shell and Halo are required to do so by law, will your personal data be provided to supervisory agencies, fiscal authorities and investigative agencies.
5. For what period do we retain your personal data?
Upon your request to discontinue your participation in the Loyalty Program or by deleting Shell Recharge we will close the applicable accounts as soon as reasonably possible. We will also close or deactivate inactive customer accounts and close accounts that are used in violation of this Privacy Policy or applicable Terms and Conditions. Personal data from closed or deactivated accounts will be deleted or rendered anonymous as soon as is reasonably possible. Under certain circumstances we will retain personal data from closed or deactivated accounts for longer, such circumstances being the prevention of fraud or to otherwise take actions permitted or required by law.
6. Which cookies do Shell and Halo use?
Shell Recharge uses cookies or similar technology. A cookie is a small text file that is sent to your internet browser so that we are able to recognise your browser when you return. Shell, Halo and its authorised service providers may use small graphic images known as ‘clear GIFs’ that work in conjunction with cookies to identify you and your use of Shell Recharge. Shell, Halo and such service providers may also use other technologies to store information in your browser utilising local shared objects or local storage, such as HTML 5 cookies, flash cookies and other web application software methods.
Using these technologies we can collect data on the use of Shell Recharge such as which pages are visited, your interaction with information on the Website and the duration of your visit.
Functional cookies
Shell and Halo store cookies that are essential in providing the functionalities of Shell Recharge. For instance, the cookies remember your preferences, such as language and region, which remain as your default settings when you revisit Shell Recharge. Shell and Halo do not retain a cookie longer than necessary. We use session cookies and permanent cookies:
- A session cookie can track usage such as the webpages you visit and what options you use. When you close the internet browser, the session is ended and the cookie is deleted.
- A permanent cookie enables Shell Recharge to recognize you at a subsequent visit. It remains on your system until you delete it.

We have a Facebook page. When you communicate with us through our Facebook page (for example, when you post a comment, upload media, send a personal message or become a fan of us by clicking the "Like" button, we may receive personal data about you (such as your (user) name, profile photo, your hometown, your email address and your gender).
